  • Reading the fine print...

This is a neighbor's dilemma. 09/07 they wanted to 'clear out a few closets' and ordered a dumpster. A 4cy unit was brought out and the lady signed the front of the page. They decided to keep it for a few more months and just continued paying the $29.44/month. Over time the cost has been inching up. It's now at $58 and change. Late last year, 2010 the 4 cy unit was swapped for a 6 cy unit. A couple phone calls and they found the company unwilling to relent, except to 'work with you' on setting up a different size unit and thus lowering the cost/month. It was also pointed out that the contract states it was for five years. So, I was invited to read it. (I'm no lawyer, just a good friend). Yep, the contract's for five years. The first time. It automatically goes to three years after that. The base price for the 6 cy unit they signed for remains the same, but the contract provides for variation for fuel costs and other service costs. Termination can be accomplished if a written request is sent via certified, registered letter with return receipt requested 60 days prior to termination. If the company is being replaced with another, the signing people MUST give a copy of the new contract and it's cost to the original company and give them a chance to counter. If the the termination is requested for a time other than the normal end of the contract period then the same letter requirements apply, with the addition of six months rental and fees due, along with the expected return of value of the future contents as based on the past three months value.
These are 70 year old people. It appears they must pay at least the 6 months cost of getting out from under this contract. Terrible situation to be in, as their medical casts are rising rapidly due to both having ailing health.
An 8.5 x 14 page with very fine print filling it top to bottom. For a dumpster. For a residence. To clean out closets.
Imperative to read the fine print. But, who among us does that? Especially when purchasing trash collection?!!
