When you fill a bathtub almost to the overflow, with the stopper in place, what happens to the water level? Does the water level rise up in the overflow pipe or is it at a level slightly less in the overflow. Assuming the statement that "water seeks its own level." - HayZee

there is no water in the overflow pipe

if you have a lift & turn, toe tap or rubber stopper the water is stopped before it enters the drain.

If you have the conventional lever lift handle on the overflow the actual stopper is located in the overflow line at the Tee where the line from the tub shoe connects. The actual stopper is tubular so that when it is dropped in place in the tee it will stop water from entering from the side opening of the tee, but the stopper is tubular and open in the vertical direction to permit any water entering the overflow a path to pass through the stopper and on to the drain.
